Credit card processing and merchant services in Paterson, NJ
A Paterson shop that adds a credit card fee has to keep it at or below its real processing cost and off debit cards entirely. Certified Urban Enterprise Zone businesses also run two sales tax rates.
Paterson had an estimated 161,793 residents on July 1, 2025, according to the Census Bureau, about 1.3% more than its 2020 base. If you sell to them and want to pass card costs along, New Jersey sets a firm ceiling. P.L. 2023, c. 146 says a credit card surcharge can't be greater than your actual cost to process the payment.
That cost isn't the rate in a processor's ad. It's what your credit card sales actually cost you, and it moves with your card mix, since premium rewards cards and keyed-in sales usually cost more than a basic card tapped at the counter. A flat 4% on everything can overshoot it, and Visa caps surcharges at 3% anyway. Debit is out entirely: Visa and Mastercard don't allow surcharges on debit or prepaid cards, so the fee can only touch credit. Our debit card surcharge guide explains why.
The notice has to come before the customer incurs any charge. In the shop, that means signs at the point of entry and the point of sale. Online, in an app or at a kiosk, it means before checkout, and phone customers have to hear it. The Division of Consumer Affairs says stating the fee as a percentage is fine.
Paterson is also on the Department of Community Affairs' list of Urban Enterprise Zone municipalities. Certified businesses collect 3.3125% on most qualifying sales of tangible goods at their zone location, and everyone else charges the standard 6.625%. Walk-in retail customers can pay cash under state law, though phone, mail and online orders are excluded.
The New Jersey page has the statutes, and our Newark page goes further into running two UEZ tax rates. Before you print a surcharge sign, send a statement for a free statement review. We'll work out your real credit card cost, so the number on the sign holds up.

Common questions
Can a Paterson shop charge a flat 4% on every card?
No. New Jersey caps a credit card surcharge at your actual cost to process the payment, Visa caps surcharges on its credit cards at 3%, and neither Visa nor Mastercard allows any surcharge on debit or prepaid cards. A flat 4% on every card breaks the network rules on debit and on Visa credit, and it may exceed your actual cost as well.
How does a Paterson business start charging the 3.3125% UEZ rate?
By getting certified first. Paterson is on the Department of Community Affairs' list of Urban Enterprise Zone municipalities, but only certified businesses collect the reduced rate, and only on most qualifying sales of tangible goods made at their zone location. Until you're certified, charge 6.625%. Our Newark page explains running both rates in one POS.
Can my Paterson store put up a card-only sign?
Not for in-person sales. New Jersey requires anyone selling goods or services at retail to accept legal tender and bars requiring payment by credit, with civil penalties of up to $2,500 for a first offense and $5,000 for a second. Telephone, mail and internet sales are outside the rule.
Do online orders from a Paterson business need a surcharge notice too?
Yes. New Jersey's 2023 law requires disclosure before the customer incurs any charge, which online, in an app or at a kiosk means before checkout. Phone orders need a verbal disclosure. In the shop, the notice goes on signs at the point of entry and the point of sale.
What can a Paterson business do about card costs besides surcharging?
Find out what you're paying first. Divide a month's processing fees by your card sales, then compare that with what the same cards would cost on interchange-plus pricing, which lists network fees and our margin separately. There's no long-term contract or cancellation fee, and a free statement review runs the comparison for you.
