Overland Park voters changed the city's sales tax in June 2023. In a mail-in election, they approved a three-eighths-cent sales tax for city streets and traffic systems, which replaced the old one-eighth-cent tax starting in April 2024. If a terminal or online checkout in the city was set up before then and nobody has touched it since, its rate may be a quarter point low.

The city rate isn't the only local piece. Overland Park has used transportation development districts, where an extra sales tax applies only to retail sales inside the district; a 2013 ordinance set one district's tax at 1%. Two stores in the same city can therefore owe different rates. Local rate changes in Kansas take effect only at the start of a quarter (January 1, April 1, July 1 or October 1), so check each address against the Department of Revenue's quarterly updates when a quarter turns, not just when you open.

Food needs its own category too. The Kansas state rate on food and food ingredients has been 0% since January 1, 2025, while prepared food carries the full 6.5% state rate. Confirm how local taxes apply to food at your address before you set up POS terminals.

Kansas, unlike Missouri, has a surcharge statute. Since January 1, 2025, K.S.A. 16a-2-403 has required a clear and conspicuous notice of the surcharge amount, posted at the point of entry or point of sale, before you add one to a credit card payment. Kansas sets no cap, so Visa's 3% and Mastercard's 4% apply. Our Kansas page has the statute, and if you also run a location in Kansas City, Missouri, our Kansas City, Missouri page covers that side.

The Census Bureau's July 1, 2025 estimate puts Overland Park at 203,677 people, 3.3% more than in April 2020. We serve businesses there remotely on interchange-plus pricing, and our surcharging program includes the notice Kansas requires. A free statement review is the place to start.

Overland Park has used transportation development districts, which carry a sales tax that applies only to retail sales inside the district's boundaries. Common questions

What changed in Overland Park's sales tax in 2024?

The city's dedicated street and traffic tax went from one-eighth of a cent to three-eighths. Voters approved the new tax in a June 2023 mail-in election, and it replaced the old one starting in April 2024. Check that any terminal or online checkout set up before then picked up the quarter-point increase.

Why can two Overland Park stores charge different sales tax?

Because some local taxes apply only inside a district. Overland Park has used transportation development districts, where an extra sales tax, 1% in the district covered by a 2013 ordinance, applies to retail sales within the boundaries. Check each store's address against the Kansas Department of Revenue's quarterly rate updates.

Can an Overland Park business surcharge credit cards?

Yes, under K.S.A. 16a-2-403, if you disclose the surcharge amount with a clear and conspicuous notice at the point of entry or the point of sale before the transaction. Kansas has no cap of its own, so Visa's 3% and Mastercard's 4% limits apply, and debit cards can't be surcharged. Our surcharging program covers the notice.

Does my Missouri location follow Kansas rules?

No. Each location follows the law of the state it's in. A store in Kansas City, Missouri has no state surcharge statute to follow, while your Overland Park store needs the Kansas notice, and each collects its own state's sales tax. Our Kansas City, Missouri page covers the Missouri side.
