Credit card processing and merchant services in Topeka, KS
Topeka's restaurants, bars and hotels took in $430.9 million in 2022. Kansas lets them add a credit card surcharge, but only after a clear notice of the amount at the door or register.
A Topeka restaurant or bar can add a credit card surcharge, as long as guests see the amount first. Since January 1, 2025, K.S.A. 16a-2-403 has allowed a surcharge on credit card payments when a clear and conspicuous notice shows the amount at the point of entry or the point of sale, before the transaction. For a sit-down restaurant, that usually means a sign at the entrance plus a line on the menu, so guests know before they order. Kansas has no cap of its own. Visa's 3% and Mastercard's 4% limits apply, and debit cards can't be surcharged.
Those sales add up. The 2022 Economic Census put Topeka's accommodation and food services sales, the category that covers restaurants, bars and hotels, at $430.9 million, next to $2.86 billion in retail sales. The city had 125,795 residents in the Census Bureau's July 1, 2025 estimate, 0.6% fewer than its April 2020 base of 126,609.
Food needs two tax categories. The state rate on food and food ingredients has been 0% since January 1, 2025, while prepared food still carries the full 6.5% state rate, so a grocery's deli counter is taxed differently from the shelves around it.
For your combined rate, add the local taxes at your address to the 6.5% state rate and confirm the total with the Kansas Department of Revenue. Local rates move only on January 1, April 1, July 1 or October 1, so a terminal that was right last quarter can be wrong this one.

Common questions
Can a Topeka restaurant put a credit card surcharge on the check?
Yes, if you disclose the amount first. K.S.A. 16a-2-403 requires a clear and conspicuous notice at the point of entry or the point of sale before the transaction, so post it at the entrance and on the menu. Keep the fee within Visa's 3% and Mastercard's 4% caps and your cost, and leave debit cards out.
Does a Topeka bar have to show its surcharge before opening a tab?
Post it before then. Kansas requires the notice before the transaction, at the point of entry or the point of sale, so a sign at the door and another at the bar reach guests before they hand over a card. Tell your acquirer 30 days ahead as well, since Visa requires it. Our bar POS guide covers tabs.
How is food taxed at a Topeka grocery with a deli?
Two ways. Since January 1, 2025, the state rate on food and food ingredients has been 0%, but prepared food from the deli carries the full 6.5% state rate. Local taxes are worked out separately, so confirm how they apply to each category at your address before you set up your POS terminals.
How do I confirm the combined sales tax rate for my Topeka location?
Start with the 6.5% state rate, add the local taxes that apply at your exact address, and confirm the total with the Kansas Department of Revenue. Do it again before each January 1, April 1, July 1 and October 1, the only dates when Kansas local rates change.
