Credit card processing and merchant services in Alabama
No Alabama law caps card surcharges, so Visa and Mastercard set the limits. The state's tax on groceries also dropped to 2% on September 1, 2025, which your POS may not know yet.

Alabama has no law that caps or bans credit card surcharges, at least none we've found, and the 2016 survey of state surcharge statutes by the National Conference of State Legislatures lists none for the state. So the card networks draw the lines here. Visa lets you add up to your merchant discount rate or 3%, whichever is lower, once you've given your processor 30 days' notice. Mastercard's ceiling is your average effective rate for its credit cards or 4%. Neither network allows a fee on debit or prepaid cards.
The bigger recent change at Alabama checkouts was on the tax side. Act 2025-305 cut the state sales tax on food from 3% to 2% on September 1, 2025, while most other goods stay at the 4% state rate. Cities and counties then stack their own rates on top. If you run a grocery, a convenience store or a gas station market, open your POS and confirm the food tax code uses the 2% state portion, not the old 3%.
Some Alabama towns are growing fast enough to show up in national rankings. The Census Bureau's 2025 estimates put Foley's one-year growth at 7.8%, to 30,354 residents, 14th among all US cities of 20,000 or more. If you're opening in a town like that, choose a processor the way you'd choose a lease: read the exit terms and how the price is calculated before you sign.
Clearo prices on interchange-plus, with no long-term contract or cancellation fee and a dedicated rep on every account. A free statement review shows what your current processor really charges. If you then decide to pass some of that cost on, our surcharging program takes care of disclosure and setup.
What Alabama merchants should know
Credit card surcharges in Alabama
We haven't found an Alabama statute that bans or caps credit card surcharges, and the 2016 NCSL table of state surcharge laws lists none for Alabama. The card networks' rules still apply:
- Visa: no more than your merchant discount rate or 3%, whichever is lower, with notice to your acquirer 30 days before you start.
- Mastercard: no more than your average effective merchant discount rate for Mastercard credit or 4%.
- No surcharge on debit or prepaid cards under either network's rules.
- Disclose the fee at the point of entry, at the point of sale, and on every receipt.

State and local sales tax
Alabama's general state sales tax rate is 4%. Food and groceries have their own state rate, which Act 2025-305 lowered from 3% to 2% on September 1, 2025. Cities and counties levy their own sales taxes on top of the state rate, and the Department of Revenue publishes a file of local rates.
Set your POS tax codes by store location, keep groceries on their own code, and run a test sale with one food item and one general item before you go live.

Debit cards cost less to accept
Debit cards can't carry a surcharge, but they are usually the cheapest cards you take. Federal Regulation II caps the interchange that banks with $10 billion or more in assets can charge on a debit sale at 21 cents plus 0.05% of the amount, plus a 1 cent fraud-prevention adjustment for issuers that qualify.
On a $60 sale, that cap works out to 25 cents.

Common questions
Can I add a credit card surcharge in Alabama?
Yes. Alabama has no surcharge statute that we know of, so Visa and Mastercard write the rules: no more than your cost or 3% on Visa credit, your cost or 4% on Mastercard credit, 30 days' notice to your processor for Visa, and signs at the door and the register. Debit and prepaid cards are off limits.
What sales tax rate applies to groceries in Alabama now?
The state rate on food fell from 3% to 2% on September 1, 2025, under Act 2025-305. General merchandise stays at the 4% state rate. Your city and county add their own rates to both, so the total depends on where you sell. If your POS food code was set up before September 2025, check it.
Do I need to tell anyone before I start surcharging?
Visa requires notice to your acquirer, the bank or processor behind your merchant account, at least 30 days before you start. Mastercard says it isn't currently requiring merchants to register their intent while it revises its rules. Our surcharging program covers the compliance and setup steps if you go ahead.
Is debit cheaper than credit for my Alabama store?
Usually, yes. For cards from banks with $10 billion or more in assets, federal Regulation II caps debit interchange at 21 cents plus 0.05% of the sale, plus a 1 cent fraud adjustment. On a $60 ticket that's 25 cents, well under what most credit cards cost. That's one reason a debit surcharge is both banned by the networks and rarely worth wanting.
How does Clearo price card processing for Alabama businesses?
On interchange-plus: you pay the card networks' interchange and assessment fees at cost, plus our disclosed markup, and your statement shows both. There's no long-term contract and no cancellation fee. Send a recent statement for a free statement review and we'll show you your effective rate.
