Credit card processing and merchant services in Florida
Florida's surcharge ban is still printed in the statutes, though the Attorney General says courts struck it down. Add county surtaxes that follow the delivery address, and your register has two things to get right.

Florida's surcharge law is an odd one. Section 501.0117 of the Florida Statutes still says a seller who takes credit cards may not add a surcharge for paying with one, and it's printed in the 2025 statutes. The Attorney General's consumer page, though, says federal courts held that law unconstitutional and that merchants in Florida may add a surcharge to credit card purchases. The same page warns that undisclosed fees may be an unfair or deceptive trade practice under state law.
So a surcharge is an option here, with conditions. Visa caps it at 3% or your merchant discount rate, Mastercard at 4% or your average effective rate, debit and prepaid cards are excluded, and the fee has to be posted at the entrance and the register and shown on the receipt. The statute also carves out discounts for paying by cash or check, as long as every customer is offered the same discount.
Sales tax adds a county layer. The state rate is 6%, and many counties add a discretionary sales surtax that follows the delivery: what counts is the county where the item or service is delivered, not the county your store sits in. For certain transactions, only the first $5,000 of a sale is subject to surtax. Across the nine Florida cities we cover, combined rates run from 6.5% in Orange and Lee counties (Orlando and Cape Coral) to 7.5% in Duval, Hillsborough and Leon counties (Jacksonville, Tampa and Tallahassee).
Our pages for Jacksonville, Miami, Tampa, Orlando, St. Petersburg, Tallahassee, Fort Lauderdale, Port St. Lucie and Cape Coral cover each county's rates, and most cover its lodging taxes too. Wherever you are in the state, we price on interchange-plus with no long-term contract, and a free statement review shows what you're paying now.
What Florida merchants should know
Credit card surcharges in Florida
Section 501.0117 says a seller or lessor may not impose a surcharge on a buyer for electing to use a credit card instead of cash, check or similar means, and the section is still in the 2025 Florida Statutes. The Attorney General's office says federal courts held the law unconstitutional and that Florida merchants may add a surcharge to credit card purchases. It also warns that undisclosed fees may be an unfair or deceptive trade practice.
Card network rules still set the limits:
- Visa: a Florida merchant can surcharge up to its merchant discount rate or 3%, whichever is lower, after giving its acquirer 30 days' notice.
- Mastercard: Florida businesses can add as much as their average effective merchant discount rate for Mastercard credit or 4%.
- No surcharge on debit or prepaid cards.
- Disclosure online, at the store entrance and point of sale, and on the receipt.

Cash discounts
Section 501.0117 doesn't apply to a discount offered to get customers to pay by cash, check or another method that doesn't use a credit card, as long as the discount is offered to all prospective customers.
A cash discount is a lower price for paying another way, not an extra charge for paying by card, so post your prices to match. Our post on dual pricing vs surcharging compares the two setups.

Sales tax and county surtax
Florida's general state sales tax rate is 6%, with exceptions such as 3% on retail sales of new mobile homes and 4% on amusement machine receipts. Many counties add a discretionary sales surtax. The surtax of the county where a taxable item or service is delivered applies, and for motor vehicles and mobile homes the buyer's home address decides it. For certain transactions, only the first $5,000 of a sale is subject to surtax.
The Department of Revenue collects the state tax and the surtax together and sends the surtax to the counties. Form DR-15DSS lists every county's rate and is updated each November.

Rounding and receipts
Since July 1, 2021, Florida dealers have had to use a rounding algorithm: carry the tax to the third decimal place, and if that digit is greater than 4, round up to the next cent. You can apply it to each item or to the invoice total.
Sales tax must be stated separately on every receipt or invoice. The state tax and the county surtax can be shown as one total or as separate lines.

Remote sales into Florida
Since July 1, 2021, a business making remote sales into Florida must collect and remit Florida sales tax, including any county surtax, if its taxable remote sales topped $100,000 in the previous calendar year. Marketplace providers collect on the sales they facilitate.
If you sell online, make sure your checkout applies the surtax of the delivery county.

Common questions
Can I legally add a credit card surcharge in Florida?
Yes, according to the Attorney General. Section 501.0117 still bans surcharges on paper, but the AG's office says federal courts held it unconstitutional and that merchants may add a surcharge to credit card purchases. Disclose it clearly, keep it within Visa's 3% and Mastercard's 4% caps (or your cost if lower), and leave debit and prepaid cards alone.
Is a cash discount treated differently from a surcharge in Florida?
Yes. The surcharge statute says it doesn't apply to a discount offered to get customers to pay by cash, check or another non-credit method, provided every prospective customer is offered it. The practical difference is how you post prices: a cash discount starts from the card price and takes something off.
Which county's surtax do I charge on a delivery?
The county where the item or service is delivered. If your shop is in Orange County (6.5% combined) and you deliver into Osceola County, Osceola's 7.5% applies. Motor vehicles and mobile homes are the exception: their surtax follows the buyer's home address. For certain transactions, only the first $5,000 is subject to surtax.
Do my receipts need to show the county surtax separately?
No. Florida requires sales tax to be stated separately from the price on every receipt or invoice, but the state tax and the county surtax may be shown as one total or as two lines. Since July 1, 2021, the tax must be worked out with the state's rounding algorithm.
Do I collect Florida sales tax on online orders from out of state?
If you're an out-of-state seller, Florida requires you to collect once your taxable remote sales into the state topped $100,000 in the previous calendar year, county surtax included. Marketplace providers collect on the sales they facilitate. Either way, the surtax is set by the county the order is delivered to.
